History was made this week as UK Prime Minister, Theresa May triggered Article 50 on 29th March 2017, officially meaning Britain should leave the EU no later than April 2019.
Regardless of which side you sit of the political fence over the EU referendum, Article 50 has signified the country’s exit and in two years (or thereabouts), the UK will no longer be subject to EU laws.
So, what impact does the triggering of Article 50 have on the data controllers preparing for the implementation of the EU General Data Protection Regulation (GDPR)? Is it time to put your feet up and relax?… No! The UK will still operate under EU laws until it fully leaves Europe. The GDPR is STILL a solid ‘GO AHEAD’ in the UK.
UK businesses that handle customer data will have to comply with the GDPR when it comes into practice on 25th May 2018. To recap, under the “International cooperation for the protection of personal data”, Article 50 states you must take appropriate steps to:
Develop international cooperation mechanisms to facilitate the effective enforcement of legislation for the protection of personal data.
Will the GDPR still apply after April 2019?
Data controllers within the UK will have to comply with GDPR beyond March 2019 and the UK government will retain the GDPR for the UK as the protection of consumer data becomes more and more important.
Act now for the GDPR!
For those businesses hoping to “wait and see how the GDPR will pan out”, will be taking a very risky approach. Data breaches under the GDPR will see fines of up to 4% of global annual turnover or 20 million Euros. Can you afford to take the risk? The GDPR is here to stay for the foreseeable future and you cannot hide from it.
